RFM Go Pro Sweepstakes

1. HOW TO ENTER:
The “RFM Go Pro Sweepstakes” Sweepstakes starts 12:01 am Eastern Time (ET) on 8/01/2008 and ends 11:59 pm ET on 10/31/2008 (the “entry period”). No purchase necessary. Sweepstakes open to legal residents of the 50 United States or the District of Columbia, age 18 or older as of the date of entry. Entry form and instructions will be available at www.redkenformen.com/gopro throughout the entry period. Entry form must be completed in full. You may submit your entry online or by regular U.S. mail. To submit your entry online, complete the online entry form and click the “Submit” button to enter during the entry period. To submit your entry form by regular U.S. mail, send a completed entry form or your name, address, telephone number, age, and email address to, RFM Go Pro Sweepstakes, PO Box 1069, Grand Rapids, MN 55745-1069. Limit one entry per person. Mail-in entries must be postmarked by 10/31/2008 and received by 11/07/2008. No correspondence regarding entries will be acknowledged or entered into with entrants. Employees and agents of Redken 5th Avenue NYC, Professional Products Division of L’Oréal USA, Inc. (the “Sponsor”) and Arrowhead Promotion & Fulfillment, their parent company, affiliates, subsidiaries and advertising and promotion agencies are not responsible for late, lost, incomplete, illegible, stolen, damaged, misdirected or postage due entries. Personal information collected from participant is used only for the purpose to notify the winner, and will not be re-used, sold or shared in any manner by Redken 5th Avenue NYC (the “Sponsor”), Arrowhead Promotion & Fulfillment (the “Administrator”), or any third parties, unless participant has checked the box that appears on the entry form, and opts to receive news and offers from Redken. Any mail-in entry submitted with opt-in checked will do so with the understanding that the entrant is opting to receive this information from. Once the contest has ended, all information supplied by participants who do not agree to receive such information will be removed from the database.

2. PRIZE:
One (1) Grand Prize winner, five (5) First Prize winners, and ten (10) Second Prize winners will be selected from a random drawing held on or about 11/25/2008 from among all eligible entries received. All winners will be notified by email or telephone. Odds of winning depend on number of eligible entries received. Limit one prize per person, family, household or address. Grand Prize consists of : Round- trip coach-class airfare to Monterey, CA for winner and three (3) guests from a major commercial airport nearest winner’s primary residence; three (3) nights hotel accommodations at the Lodge at Pebble Beach (2) standard double-occupancy rooms); the following prepaid rounds of golf: one (1) round on Pebble Beach Golf Links, one (1) round on The Links at Spanish Bay and one (1) round on Spyglass Hill Golf Course; four (4) Spa Treatments at the Lodge at Pebble Beach (totaling no more than $800); and $2,000 Spending Cash. Approximate Grand Prize Retail Value: $12,000. Actual retail value of the Grand Prize may vary due to location of winner and fluctuations in airfare and room rates at the time the trip is taken. If actual value of the trip is lower than the ARV, the difference will not be awarded in cash. Winner and guests must travel together on the same itinerary. If winner is otherwise eligible under these rules, but is nevertheless deemed a minor in his or her state of primary residence, the prize will be awarded in the name of winner’s parent or legal guardian who must execute and sign the Affidavit on winner’s behalf. A parent or legal guardian must accompany a traveling minor. Winner and guests are responsible for obtaining proper documentation (e.g., valid photo ID) prior to travel. Guests must complete and return a Liability/Publicity Release prior to travel, except where prohibited. Certain blackout dates and restrictions may apply. Grand Prize does not include any costs or charges not expressly stated above, including, without limitation, ground transportation, meals, hotel incidentals, equipment rentals, gratuities or service charges, all of which are the responsibility solely of the winner. Ground transportation will be substituted for air travel if winner lives within one-hundred (100) miles of Monterey, CA. First Prize includes: One (1) Callaway Big Bertha Fairway Wood. Approximate First Prize Retail Value: $200. Second Prize includes: One (1) Redken For Men Gym Bag with an assortment of Redken For Men products. Approximate Second Prize Retail Value: $108. Prizes will be awarded “as is” with no warranty or guarantee, either express or implied by Sponsor. All prizes will be awarded by March 31, 2009 of receipt of valid and executed winners’ affidavit or prize confirmation. However, any portion of the prize not accepted by the winner will be forfeited. If any prize is forfeited and there is sufficient time to notify an alternate winner, the prize will be awarded to an alternate winner is a separate random drawing from among all non-winning eligible entries. All trips/prizes must be taken between [January 2009 and March 2009] All expenses not specified are the sole responsibility of prize winners. Void where prohibited. No substitution or transfer of prize permitted except at Redken 5th Avenue NYC’s sole discretion. Prizes are not redeemable for cash. All federal/state/local taxes are the sole responsibility of prize winners. Winners will be sent an IRS Federal 1099-MISC tax form for the retail value of any prize at or above $600. Sponsor reserves the right to substitute prize of equal or greater value if an advertised prize becomes unavailable. No substitution, cash equivalent or transfer of prize permitted, except by Sponsor, who reserves the right to substitute a prize or prize component of comparable or greater value.

3. ELIGIBILITY:
Open to legal residents of the 50 United States or the District of Columbia, age 18 or older as of the date of entry. Entrants Employees and agents of Sponsor, Arrowhead Promotion & Fulfillment, their respective parent companies, affiliates, subsidiaries, advertising and promotion agencies, their respective immediate families (spouse, parents, children, and siblings and their respective spouses) and individuals living in the same households of such persons (whether related or not) are ineligible to enter or win. Void in Puerto Rico and Canada and where prohibited by law. Subject to all applicable federal, state and local laws. By participating, entrants agree to be bound by these Official Rules and accept decisions of the Sponsor as final in all matters relating to this contest. Proof of mailing entry does not constitute proof of delivery.

4. TO CLAIM PRIZE:
Potential winners will be notified by regular mail, email or telephone on or about 11/30/2008. All potential winners must execute an Affidavit of Eligibility/Release of Liability/Prize Acceptance Form for the winner and companion within 15 days of notification. Noncompliance/return of prize notification as undeliverable will result in disqualification and selection of an alternate winner in a random drawing from among all remaining eligible non-winning entries. Potential Guests/ Companions of Grand Prize Winner must also execute a Release of Liability within 15 days of notification to be eligible for travel.

5. LIMITATIONS:
L’Oréal USA, Inc. and Arrowhead Promotion & Fulfillment and their respective parents, subsidiaries or affiliate companies and each of their respective officers, directors, employees, representatives and agents (the “Released Parties”, shall have no obligation or responsibility with regard to (i) entries that contain inaccurate information or do not comply with these rules, (ii) entries, prize claims or notifications that are lost, late, incomplete, illegible, unintelligible, damaged or otherwise not received by the intended recipient, in whole or in part, due to computer, human or technical error or any kind, (iii) telephone, electronic, hardware, software, network, Internet or computer malfunctions, failures or difficulties, (iv) any inability of the winner to accept the prize for any reason; (v) if a prize cannot be awarded due to travel cancellation, delays or interruptions due to Acts of God, natural disasters, terrorism or weather; or (vi) any damages or losses of any kind caused by any prize or resulting from awarding, acceptance, possession, use, misuse, loss or misdirection of any prize or resulting from participating in this promotion or any promotion or prize related activities. By participating this Sweepstakes, entrants (or, if entrant is considered a minor in their state of residence, his/her parent or legal guardian) hereby agree to release and hold harmless the Released Parties from and against any and all claims of liability (including, without limitation, injuries, damages, expenses or losses) which may be caused, directly or indirectly, in whole or in part, by entrant’s participation in this promotion or the acceptance, use or misuse of any prize awarded (including any travel or activity related thereto). Sponsor and the Administrator, in their sole discretion, reserve the right to disqualify any person tampering with the entry process or the operation of this sweepstakes or otherwise violating these rules. If Sponsor or the Administrator determine, in their respective discretion, that technical difficulties or unforeseen events outside their control compromise the integrity or viability of the promotion, Sponsor or the Administrator reserve the right to void the entries at issue, modify the promotion and/or terminate the relevant portion of the promotion.

6. GENERAL CONDITIONS:
Sponsor reserves the right to disqualify any person tampering with the entry process, the operation of the Redken website, or who is otherwise in violation of the Official Rules. Sponsor further reserves the right to cancel, terminate or modify the Sweepstakes in the event the Sweepstakes is not capable of completion as planned, including infection by computer virus, bugs, tampering, or technical failures of any kind. In the event of a dispute as to entries submitted by multiple users having the same email account, the authorized subscriber of the email account used to enter the Sweepstakes at the actual time of entry will be deemed the entrant and must comply with these Official Rules. Authorized account subscriber is deemed to be the natural person who is assigned an email address by an Internet access provider, on-line service provider or other organization which is responsible for assigning email addresses or the domain associated with the submitted email address. CAUTION: ANY ATTEMPT BY ANY PARTICIPANT TO DELIBERATELY DAMAGE THE REDKEN WEBSITE OR TAMPER WITH OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, SPONSORS RESERVE THE RIGHT TO SEEK REMEDIES AND DAMAGES FROM ANY SUCH ENTRANT(S) TO THE FULLEST EXTENT PERMITTED BY LAW INCLUDING CRIMINAL PROSECUTION. By participating, entrants agree to be bound by these Official Rules and the decision of the judges. Winners consent to the use of his/her name and/or photograph for promotional purposes, including online announcements, without additional compensation, except where prohibited by law. Entrants agree that their entry will be owned by the Sponsor and Administrator and its designees shall have the right to publish, use, adapt, edit and/or modify such entry in any way including in commerce and in any and all media worldwide, including but not limited to the Internet, without limitation and without compensation to the entrant. Entrants represent that their entries, and the Sponsor’s and Administrator’s use thereof, will not infringe upon the rights of any third parties. Except where prohibited, all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of New York without giving effect to any choice of law or conflict of law rules (whether of the State of New York, or any other jurisdiction) which would cause the application of the laws of any jurisdiction other than the State of New York. In addition, any dispute relating to the Sweepstakes (including these Official Rules) shall be brought in the appropriate state or federal court having jurisdiction over the subject matter located in the City and County of New York. Entrants hereby irrevocably consent to the personal jurisdiction of said courts and waive any claim of forum non convenients or lack of personal jurisdiction they may have.
